This is one of key topics of the Memorandum of Understanding (MOC) on the basic legal framework for implementing the “Specified Skilled Worker” program between Vietnam and Japan in the area of labor cooperation, signed by Mr. Dao Ngoc Dung – Minister of MOLISA and Mr. Yamashi Takashi – Minister of Justice of Japan on July 1st in Tokyo, Japan.
MOC signing ceremony is organized with the presence of Mr. Nguyen Xuan Phuc – Prime Minister of Vietnam, Mr. Abe Shinzo – Prime Minister of Japan, and relevant representatives from departments of both nations.
Upon MOC, Japanese accepting companies only accept Vietnamese specified skilled workers, who comply with all necessary procedures under Vietnamese laws and listed in “verified list” published by MOLISA.
They are employees sent by organizations, companies that are allowed by MOLISA to send specialized skilled workers to work in Japan; Vietnamese citizens currently residing in Japan have been directly recruited by an employer (including those who are exempt from tests and examinations; trainees who have completed the skilled internship program No.2 or 3 of Japan; international students who have graduated at least 2-year courses of Japanese schools and passed the vocational and Japanese skills tests).
In addition, to limit the use of the study abroad program to send workers to work in Japan, another regulation is supplemented in the MOC named “It is strictly prohibited for Vietnamese citizens currently residing in Japan, who are not eligible, including international students who are expelled from school, skilled interns breaking contract, or people registering for refugee capacity, to take skills tests in Japan” …

“MOC has ensured the strictness, limiting individuals and organizations, that do not have the function, to take advantage of the study abroad form to send workers to work in Japan, and is a basic legal framework to ensure the assignment and reception of specialized skilled workers to be carried out smoothly and in compliance with the laws of both nations", emphasized in the notice of the Ministry of Labor, Invalids and Social Affairs on the afternoon of July 1st.
